auto market from metro route: HC

GURGAON: The Haryana government has been ordered by
Punjab and Haryana high court to finalize the land for shifting of the proposed
automobile market from Sector 9 to make sure that the work on the Delhi-
Bahadurgarh Metro line doesn't suffer any hiccups.
On December 18, the double bench of Justice Jasbir Singh
and Justice Rameshwar Singh Malik had taken up the petition and had given the
order to expedite the shifting of the market to the new place.
After the announcement of the ambitious Metro project, it
was found that at one station, the state had earmarked land in Sector 9 to set
up an automobile market for which a foundation stone was laid in 2004. Now, the
proposed land has to be given for Metro project.
Upset with the development, the Bahadurgarh Automobile
Association had moved the court seeking direction to the state government to
resolve the issue of allotment of land and shifting of the market to the other
place. The court also found no justification in delaying the shifting of the
market and held that it is in interest of the public if all the auto dealers
are made to work at one place.
The petitioners submitted in the court that the land in
Sector 9 was acquired and the process of setting up the market had started in
2004. Later, the petitioners came to know that the land is required for
extending the Metro Line of the DMRC from Delhi to Bahadurgarh.
The state government council had informed the court a
high-level committee, is working on the project of developing a Transport Nagar
in Sector 17 by the HSIIDC.
The council also submitted that the process of acquiring
land in the new place is pending for past one year.The court gave three months
to the state government to finalize the land and shift the automobile market.

Jitender Singh, AGM, HSIIDC, Bahadurgarh Industrial Estate said, "The HSIIDC has approved 2 acres of land for developing R&D Centre to aid the footwear industries based in Bahadurgarh and outside the city."
MONEY MATTERS
Raj Kumar Gupta, president, Footwear Park at Bahadurgarh and managing director of Action Shoes said, "The entire footwear industry in India is facing a skilled labour crunch. To fill this gap, we needed an R&D centre."
Elaborating further on the cost, he added, "We are getting a government subsidy of Rs 10.5 crore. While the cost of buying and installing machines - Rs 9 crore - would be borne by ministry of MSME, the construction cost (Rs 1.5 crore) would be borne by the government of Haryana. Industry players, who are members of our organisation, would pay the rest of the amount that is, Rs 4.5 crore."
WHAT'S ON OFFER
The centre would train around 10,000 workers every year and the courses offered in this centre would span from one week to one year, depending upon the need of the industry and requirement of the training for the applicants, informed Subhash Jagga, general secretary, Footwear Park, Bahadurgarh.
Asked about the course fee, Jagga, who is also a member of the Bahadurgah Chamber of Commerce and Industry ( BCCI) said, "The course fee would vary from Rs 500 to Rs 10,000 depending upon the time frame of the course."
Jagga is optimistic about the centre. "Bahadurgarh is home to around 500 footwear units, which create direct job opportunities for around 50,000 people. Apart from this, there are about 1 lakh indirect jobs. So, the students of the R&D Centre would easily get a placement in the units."
REASON FOR R&D CENTRE
The proposed R&D centre will not be the only institute dedicated to footwear. Twenty five kms away in IMT Rohtak is the Footwear Design and Development Institute (FDDI).
"The footwear park in Bahadurgarh will enjoy the benefits of various services offered by FDDI, including industrial consultancy in the field of design, productivity improvement, quality control, man and machine utilisation, inventory control etc.," said Rajeev J Lakhara, managing director, FDDI.
The 1992 batch Indian Revenue Service further added that the footwear industry based in and around Rohtak would reap the benefits of the research and development carried out at FDDI. The training of active industry professionals is one of the most pivotal services of the institute.
But Gupta opined that FDDI would have aided more had it been nearer to Bahadurgarh. To this, Jagga added: "The centre will train recruits which will help units inside and outside the Bahadurgarh Industrial Area."
WHAT NEXT
The units now await a 132 KVA power sub-station. "When it becomes operational, there will be ample power supply for the 375 units in Bahadurgarh Footwear Park," said Subhash Jagga. The units include, footwear giants such as, Action Shoes, Lakhani, RelaxoBSE -0.18 %, Lancer Shoes, Welcome, Diamond, etc.
Once operational, the park would become 100 percent production efficient. "On an average, one unit does business worth Rs 4 crore to Rs 5 crore per annum. The figure can head further north, once the power sub-station becomes 100 percent operational," said Jagga.
Jitender Singh of HSIIDC informed that the substation would become operational by the end of March this year.

BAHADURGARH: Bahadurgarh Inc is expecting a boom in the
industrial sector on account of the development of new sectors in the
industrial estate by the Haryana State Industries and Infrastructure
Development Corporation (HSIIDC).
With 121 operational units and another 387 units to
become operational by mid 2013, HSIIDC is expected to create business
opportunities worth Rs 3,000 crore annually and jobs for nearly 75,000 people
in the local economy. The industrial estate is spread in 555 acres of land,
which is expected to give home to around 600 units.
There are 121 units, which are operating in the
Bahadurgarh Industrial Estate developed by the HSIIDC and 235 more units would
become operational in Sector 17 by January 2013, while 152 units would become
operational by July 2013," said Gulshan Kumar, DGM, HSIIDC, Industrial
Estate, Bahadurgarh. He said that Sector 17 is completely devoted to the
footwear park, while sector 16 will have general industries.
REVENUE GENERATION
Talking about the investment, the HSIIDC official said,
"The total cost of land and infrastructure development is estimated at Rs
100 crore. Apart from this, an investment of Rs 1,008 crore is expected from
the industrialists for setting up their plants and required machinery in the
region."
Subhash Jagga, general secretary of the Bahadurgarh
Footwear Park and member of the Bahadurgarh Chamber of Commerce and Industry
said, "On an average, one unit in the region would generate around Rs 5
crore per annum business. Hence, the estate is expected to add nearly Rs 3,000
crore in the industrial revenue generation of the city." However, Jagga
reminded that the figures would be a reality only when the 132 KVA power
sub-station becomes operational in the Bahadurgarh Industrial Estate.
LAND MANAGEMENT
The entire estate is spread in around 555 acres of land,
where size of plots range from 450 square metres to 4 acres in Sector 16. In
Sector 17, plots range from 450 sq m to 2.5 acres,"said Jitender Singh,
AGM, HSIIDC, Bahadurgarh.
According to Singh, the major allottees in the industrial
estate are Relaxo Footwear, Welcome Footwear, Diamond Footwear, Sumanglam
Impex, Rinder India, Shri Bankey Bihari Embroidery, Ambika Forging, Hemstich
India, Prudent Metal etc. The HSIIDC officer further added, "The industrial
estate would generate around 28,000 direct job opportunities in the
region."
When you count job creations, you need to count the
indirect job creations as well, pointed out Subhash Jagga of Bahadurgarh
Chamber of Commerce and Industry. "The units here in Bahadurgarh create
around 1.5 to two times of their direct jobs. Therefore, net job opportunities
being created by the Bahadurgarh Industrial Estate would be around 70,000 to
75,000," said Jagga.
 FURTHER EXPANSION
In view of the overwhelming response from the
entrepreneurs, the HSIIDC has further acquired about 177 acres of land for the
Industrial Estate in Sector 4B, Bahadurgarh. Total 46 plots have been carved
out in this new sector, whereas 25 acres of land has been allotted to Yokohama
India Private Limited," said Jitender Singh of HSIIDC. Singh further
added, "Yokohama is a prestigious project for us as it involves investment
of around Rs 965 crore and job opportunities for nearly 900 people."
Other big units in Sector 4B are Neolite, ZKW Lightings,
Adlec Systems etc. Total project cost at Sector 4B for providing
infrastructural facilities including a water treatment plant (WTP) and disposal
of storm water drainage is Rs 85 crore," said Jitender Singh. He said that
around 65 percent of the developmental work would be completed by March 2013

GURGAON: Even as the
Haryana and Delhi governments have set May 2013 the fresh deadline for
completing the 135-km Kundli-Manesar-Palwal (KMP) Expressway, the project has
made an overall progress of just about 70% so far.
The private concessionaire developing the expressway, KMP Expressways Ltd, on the other hand claims that the 53-km priority stretch between Manesar and Palwal is scheduled to be completed by November 2012 and will open to public by December. Over 85% work on the stretch has been completed, with all the 83 major structures ready and already connected to the main carriageway.
The major structures on the stretch include 14 small and big bridges, 8 cattle crossings, 12 agriculture vehicle underpasses, 23 pedestrian crossings, 21 underpasses and 5 box culverts.
At present, the final layer of dense bituminous macadam, the commonly used bituminous paving mixes in India, is being laid and has been done for up to 48 km of the total stretch of 53 km. The rest would be completed soon, said a spokesperson.
Completion of KMP Expressway will help de-congest traffic in the city as vehicles coming from Punjab, Haryana and Himachal Pradesh and going to Rajasthan, Gujarat and Maharashtra will use it to avoid Delhi and Gurgaon.
The concessionaire
made the commitment at a meeting held on June 8 2012 in Delhi between the chief
ministers of Haryana and Delhi, to open the Manesar-Palwal section for tolling
within the next 90 to 120 days and complete the expressway by May 31 2013.
Haryana chief minister Bhupinder Singh Hooda had told TOI, "Decidedly, the progress on the project is slow and the concessionaire has been asked by various authorities including the high powered committee (expressway) Haryana, monitoring committee constituted by the Supreme Court, chairman/ EPCA for NCR, besides HSIIDC and an independent consultant, to speed up the work. The HSIIDC has already imposed damages on the concessionaire for delay in meeting the commercial operation date to the extent of 0.1 per cent of the total project cost per week or part hereof since July 30 2009 till the commercial operation date is met."
According to the chief minister's office, as per the latest progress report received from the concessionaire, the physical progress achieved up to July 31 2012 is 67.76 per cent (Rs 1,003.54 crore) with monthly physical progress of 0.03 per cent (Rs 0.39 crore). The concessionaire has intimated that the gross financial progress achieved up to July 31 2012 is 76.56 per cent (Rs 1262.04 crore) with monthly financial progress of 0.02 per cent (Rs 0.30 crore).
The concessionaire, on the other hand, blames a litigation case and difficulty in getting clearances from various agencies for project delay. "Right at the beginning of the project there was a delay of 18 months due to litigation by one of the consortium partners. The project got further delayed due to much time taken in getting clearances and approvals from specific authorities. These included delays in getting clearances for crossing Indian Oil Corporation Ltd. pipelines, relocation of high tension overhead transmission lines and land acquisition issues," said the spokesperson.
There were delays in getting the final design change approvals for the railway over bridges, grade separators and design changes done in the original design to address the concerns of the local villagers.

Travelling from west Delhi to
Haryana is all set to become a smooth affair with the Public Works Department
(PWD) planning to construct an underpass at Peeragarhi Chowk. The PWD has also
decided to make the Rohtak Road-Peeragarhi Chowk signal-free to ease out
traffic jams.
Currently, the entire stretch is
marked by traffic snarls with commercial vehicles using the stretch to make
their way to Haryana.
This stretch connects outer Delhi
with central Delhi and making it signal-free will help motorists to a large
extent.
A feasibility study will also be
conducted by the department to find out the traffic situation and whether the
underpass will be able to ease traffic jams or not.
"Despite having a flyover on
the outer Ring Road — from Viskaspuri to Mangolpuri — the entire stretch is
marred by traffic jams. Though there is a proposal to have a Bus Rapid Transit
(BRT) corridor, we have decided to construct an underpass till that shapes
up," said a senior PWD official.
Currently, there is a Mundka Metro
line and a flyover on the Rohtak Road-Peeragarhi Chowk.Bottom of Form

After a
two-hour meeting with the private developer KMP Expressway Ltd on Friday, Delhi
chief minister Sheila Dikshit and her Haryana counterpart Bhupinder Singh Hooda
claimed that all issues had been resolved. They said the developer had faced
financial crunch, slowing down the project, but the problem had been solved.
The developer
has now been asked to open the "priority stretch" of the expressway
between Palwal and Manesar by mid-September or mid-October.
A senior official who attended the meeting said Haryana had warned the
developer that the contract would be terminated if it failed to meet the May
2013 deadline.
The meeting,
which was held at the Delhi secretariat, was also attended by the Supreme
Court-appointed Environmental Protection and Conservation Authority chairman,
Bhure Lal, who is monitoring the ring expressway projects.
The developer's
financial crunch was the main reason behind the delay, both CMs said, adding
that the private player claimed that it now has enough finances to expedite the
work.
The Delhi and
Haryana governments, however, failed to sort out the issue of sharing the land
acquisition cost for the project, sources said.
Due to the
delays in the land acquisition, the liability on the Delhi government has
increased to Rs 1,110 crore against the original estimate of Rs 167 crore.
"The Delhi government can't be made to pay for this high escalation just
on the ground that this expressway will reduce environmental pollution. There
will be another round of meeting at the chief-secretary level where Haryana
will submit how much land it acquired only for the road. How can huge public
exchequer be doled out to Haryana when this project will bring huge economic
prosperity only to Haryana?" asked a source in the Delhi government.
He added that
though SC had fixed the criteria of sharing the acquisition cost, Delhi could
not be made to take the burden of Haryana's inefficiencies.
The expressway
will connect NH-1 at Kundli and NH-2 at Faridabad via NH-10 and NH-8.

ALLAHABAD: Officers and employees of Central Organization of Railway Electrification were awarded during the Railway week function that was organized on Friday.
Speaking on the occasion, CP Verma, general manager of CORE observed that electrification of about 740 RKM (Route Kilo Metres) has been completed this year. Goods trains were plied on the newly electrified routes of Bina-Kota (310 RKM) of West Central Railway, Shakur Basti-Rohtak (57 RKM) of Northern Railway, Tiruchirrapalli-Dindigul (94 RKM) of Southern Railway, and Jhansi-Parichha (22 RKM) of North Central Railway. In addition to this, trains hauled by electric engines were plied on 74 RKM after getting approval from commissioner of railway safety.

For three kilometers we are not getting benefit of total money spent on project, no speed & frequency increased no reduction in Diesel or Pollution.

SUPREME COURT ORDER THAT GPA CANNOT BE TREATED AS A REGISTERED SALE DEED

The verdict won't affect validity of sale deals and powers of attorney in genuine transaction.
Property sales through the common practice of general power of attorney (GPA) will not give ownership title to the buyer.
In a landmark judgment that is expected to send a large number of property owners into a tizzy, the Supreme Court held that the GPA method of immovable property sales is not a valid form of transfer of property.
A three-judge bench presided over by Justice R. V. Raveendran said that property can be lawfully transferred only through registered sale deeds.
"A power of attorney is not an instrument of transfer in regard to any right, title or interest in an immovable property," the bench said, after interpreting various provisions of the law concerning property sales. However, the bench said the judgment will not affect "genuine transactions" under the GPA.
The judgment delivered on Wednesday would have an impact on both freehold and leasehold properties and affect the mode of transfer of property in Delhi and the National Capital Region (NCR) where GPA sales are very common. Even though it can cause some hardship to those who have already purchased property through the GPA, the order will help curb evasion of duties, flow of black money into real estate and also save people from being cheated by unscrupulous owners selling the same property to several people.
Navin Raheja, chairman and managing director of Raheja Developers said, "The court's decision will help to curb the circulation of black money to some extent in the real estate sector where titles are manipulated. Besides, many property transactions where prices are rounded off will be affected. However, overall there won't be any significant impact on normal property sales."
The apex court said there can be no mutation of property in municipal and revenue records on the basis of such documents. The bench, however, clarified that its order should not be a ground for disturbing mutations already effected by the Delhi Development Authority (DDA) or any other authority.
But, there is little relief for thousands of people who hold property without mutation as GPA sales can only be treated as existing sale agreements. An application of the order with prospective effect would have protected their interest. The court, though, stressed that it had merely reiterated the well- settled legal position that such transactions cannot be treated as completed transfers.
The court could not make the order applicable with prospective effect as it had not laid down any new law. However, it said that those who had already bought property through GPA before its judgment could use the documents to apply for regularisation of allotments and leases by development authorities.
"Nothing prevents affected parties from getting registered deeds of conveyance to complete their title. The said transactions may also be used to obtain specific performance or to defend possession under section 53A of TP (Transfer of Property) Act," the court said.
In order to ensure that GPA continues to serve its purpose, the court said its judgment will not affect the validity of sale agreements and powers of attorney executed in genuine transactions. "For example, a person may give a power of attorney to his spouse, son, daughter, brother, sister or a relative to manage his affairs or to execute a deed of conveyance."
The court further said that a person can enter into a development agreement with a land developer or builder for developing the land either by forming plots or by constructing apartment buildings. In that connection he can execute an agreement of sale and grant a power of attorney that will allow the developer to further sell the property to prospective purchasers.
While hearing a matter on the subject, the court had decided to clarify the law on the issue as such transfers had not only led to evasion of stamp duty and registration charges but had also provided scope for investing black money in real estate. Besides, such transfers were giving nightmares to bona fide purchasers as the same property could be sold to several people in the absence of verification or certification of title. A proper verification of ownership was possible only if all property were transferred through registered sale deeds.
Noting that such transactions were now not just limited to Delhi but had spread to neighbouring areas, the court had sought the views of the Centre and the states of Delhi, Haryana, Punjab and Uttar Pradesh. There was a near unanimity that such transactions should be discouraged as it caused loss of revenue and increased litigation due to defective titles.
Going into the legality of such transfers, the court said any contract of sale which was not a registered sale deed would fall short of the requirements of the relevant provisions of the Transfer of Property Act and could not confer any title.
The court said a transfer of property by way of sale could only be by a sale deed. "In the absence of a deed of conveyance (duly stamped and registered as required by law), no right, title or interest in an immovable property can be transferred," the bench said.

China Builds Property Database to Fight Speculation
China is building a database on property ownership covering 40 cities, as part of a drive to curb real estate speculation citing an unnamed official from the Housing Ministry. The database will record ownership of newly purchased homes and later be expanded to include earlier purchases. Existing ownership databases are limited to individual cities. A national database on mortgages exists but its purpose is to aid the banking system. China has put in place a series of measures aimed at reining in property prices, including curbs on home purchases in key cities. The measures have reduced property transactions in major cities, but transactions and prices in smaller cities have risen as investors shift their focus to cities where curbs aren't in effect or are loosely enforced. The expanded database would give authorities more information on home purchases and, in turn, make it easier to apply curbs on multiple property purchases.Oxbusiness, 29th August 2011

KMP e-way delay: Banks threaten action
GURGAON, 2011-08-30: The KMP Expressway project seems to be heading for bigger trouble with the latest August-end deadline set to be missed again. The consortium of 11 banks for this project has written to the Haryana government that action might be initiated against the concessionaire if it doesn't expedite the work. According to the concessionaire, the 53-km "priority stretch" between Manesar and Palwal will now be completed by November. This is the 12th deadline for the first stretch. However, looking at the progress, officials in the Haryana government feel that even if construction is put in top gear, the first phase might get completed only by December. The unprecedented delays and innumerable missed deadlines despite the state and the client - the Haryana State Industrial and Infrastructure Development Corporation (HSIIDC) - extending all possible support have caused worry for the bankers. It is equally bad for the private developer - KMP Expressway Ltd, a subsidiary of DSC Ltd. According to estimates, the concessionaire is incurring a daily loss of several lakhs on account of interest during construction (IDC). Moreover, the delays could push the project cost to Rs 3,000 crore by 2013. The present cost is about Rs 2,000 crore. The concessionaire is also facing problems on the ground because of issues related to non-payment of bills to its contractors and their sub-contractors for a few months now. Also, several minor and major structures are yet to be completed all along the 53-km stretch. About the reasons behind the delays, the concessionaire said that these were primarily due to "certain clearances from third parties like the IOCL for pipeline clearances, local agitation from villagers wanting additional structures (beyond the original scope), finalization of the change of scope items and the heavy monsoons". It also said, "With all the clearances more or less under control and the monsoon abating we are quite confident of making the stretch between Manesar and Palwal trafficable by end October/ early November..."According to DSC Ltd, delays will only adversely affect their revenues since the project had been awarded to them on a build-operate-transfer (BOT) basis for 33 years. "As a concessionaire operating on a BOT basis it is in our interest that the project gets completed on time or with minimum delay, as delays lead to additional fixed overheads, interest on loans, depreciation of plant and equipment and loss of toll revenues. Due to certain issues which are being solved there is a slight delay in starting the stretch between Manesar and Palwal," said a spokesperson.According to the Gurgaon deputy commissioner, P C Meena, the concessionaire has promised speedy action in the coming days. "We are keeping a tab on their promised progress. The district administration has decided to write to the state to initiate strict action if they fail to live up to the expectations," said Meena. The project has been planned on a unique and first-of-its kind closed-loop tolling system, wherein the user pays toll as per the distance used/ covered on the expressway. The toll rates fixed in June 2010 show that while cars would have to pay about Rs 0.75/km, light motor vehicles would pay Rs 1.25/km. Light commercial vehicles would be charged Rs 2.60/km and multi-axle vehicles including buses and trucks would have to pay Rs 4.15/ km. The concessionaire said that the toll rates would be fixed only at the time of completion. This could, in other terms, mean that in order to incur losses, the prices could be escalated (according to NHAI rates) to cover the time lost in completion by the concessionaire.

CCI TOGAY SLAPPED PENALTY OF OVER Rs 600 CRORES ON DLF
CCI today slapped a penalty of over Rs 600 crore on DLF
New Delhi : The Competition Commission of India (CCI) today slapped a penalty of over Rs 600 crore on real estate major DLF, holding it guilty of abusing its dominant position in the market and imposing unfair conditions on the sale of its services to consumers.
In its order, the anti-competitive activities watchdog asked DLF “to cease and desist from formulating and imposing such unfair conditions in its agreements with buyers in Gurgaon and suitably modify unfair conditions imposed on its buyers within 3 months of the date of receipt of the order.” The Commission levied a penalty at the rate of 7 per cent of the company’s average annual turnover of the last three years, amounting to Rs 630 crore, a sum “commensurate with the severity of the violation through such blatant abuse of dominance.”
The commission also said the abuse of dominant position has been in respect of “the basic necessity of housing and … DLF has been grossly abusing its dominant position, and that too against a vulnerable section of consumers, who have little ability to act or organize against such abuse.”
The case pertains to last year May, when, after receiving complaints by some people, who booked flats in DLF projects, the CCI had ordered an investigation by the Director General Investigations. According to one such complaint, DLF had promised to complete its residential project in Gurgaon, called Belaire, in 2009, but buyers are yet to get possession. Also, DLF has increased the number of floors in the apartment complex from the original figure given to buyers. This led to the number of apartments in Belaire increasing to 564 from 384.
After the order, the DLF scrip plunged 5.92 per cent. The Commission said that DLF and other service providers issue advertisements for launching projects without the land in question being actually purchased, registered in their name and possession taken and without taking prior approval of competent authorities.
The issue: Last May CCI received complaints from allottees who had booked flats in some DLF projects. Abuse of dominance was alleged against four developers — DLF New Gurgaon Homes Developers, DLF Home Developers Ltd and others, DLF Limited and others, and DLF New Gurgaon. One complainant, Belaire Owners’ Association, alleged that the firm had not provided Gurgaon project Blaire within promised time.
